In the Supreme Court Showdown: Tinubu vs. Atiku, Obi, and APM

As the final battle over the nation’s top leadership position looms, President Bola Tinubu is set to face off with the presidential candidates of the Peoples Democratic Party (PDP), Atiku Abubakar, and the Labour Party, Peter Obi, along with the Allied People’s Movement (APM) at the Supreme Court. This critical legal battle stems from the February 25 presidential election and has been ongoing for 60 days since the filing of an appeal by Atiku and the PDP on September 18.

At the heart of the appeals are allegations of corrupt practices, non-compliance, irregularities, and non-qualification of President Tinubu, including allegations of forgery, perjury, and dual citizenship. The APM’s case centers on the alleged unlawful double nomination of Vice President Kashim Shettima.

The battle, which has spanned almost 180 days, has now shifted to the apex court, where a seven-man panel is soon to be constituted to evaluate the previous tribunal’s unanimous judgment. The panel must determine whether the judgment aligns with the law and precedents set by the apex court or whether it is “perverse,” as claimed by the appellants.

Key arguments in the case include the alleged discrepancies in President Tinubu’s academic records, the alleged suppression of actual election scores, and the question of whether the election was characterized by non-compliance, irregularities, and corrupt practices.

While Atiku and Obi have presented their arguments with numerous reasons and even requested to tender additional evidence, President Tinubu has maintained that the appellants failed to provide strong evidence to challenge the tribunal’s findings, which upheld his election.

The Supreme Court is tasked with deciding whether to accept new evidence or nullify the 2023 presidential election based on claims of non-compliance and irregularities. The outcome of this legal battle will be closely watched, as it will determine the final verdict on the presidency.

The panel for the Supreme Court is yet to be officially constituted, but it is speculated that Justice John Inyang Okoro may lead six of his colleagues in delivering the judgment. It’s worth noting that the bench currently comprises 11 justices, including the Chief Justice of Nigeria (CJN).

Caught in the middle: Ortom’s silent dance between two camps.

Published

on

There are growing questions about where Mr. Samuel Ortom, a former Governor of Benue State and a prominent figure in the People’s Democratic Party (PDP), truly stands politically ahead of 2027.

Ortom was a key figure in the divisions within the PDP before the 2023 general elections and was widely associated with support for Mr. Peter Obi, who finished third in that contest. More recently, however, he has publicly expressed support for President Bola Ahmed Tinubu’s administration.

The latest discussion began after a visit by Mr. Peter Obi to Benue State. Reports indicate that a vehicle said to belong to Ortom was used to receive Obi at the Air Force Base airport in Makurdi. It is not clear who authorized the use of the vehicle, and Ortom has not commented publicly on the matter.

During the same visit, Obi was reportedly prevented from travelling to Yelewata, where he had intended to condole with families affected by violence. Obi’s team attributed the blockage to supporters of Governor Hyacinth Alia.

The Governor’s spokesman, Sir Tersoo Kula, denied any involvement by the Governor. He suggested the incident may have been staged to damage the Governor’s reputation, or that it could have resulted from disagreements within Obi’s own support base.

Ortom has not issued a statement clarifying his position on the 2027 elections or on the vehicle in question. Attempts to reach him were unsuccessful at the time of reporting.
