Adamawa: Supreme Court Upholds Fintiri’s Victory as Adamawa governor

The Supreme Court, on Wednesday, dismissed the appeal of the All Progressives Congress, APC, and its governorship candidate, Senator Aisha Dahiru, in the March 18 2023 gubernatorial polls in Adamawa State.
The apex court’s five member panel in a unanimous decision upheld the election of Governor Ahmadu Fintiri as the duly elected governor of the State.
The Supreme Court delivering a final judgment on the governorship election tussle held that Binani’s appeal lacked merit in its entirety, substance and cogent evidence.
The court on this note dismissed the appeal.
The judgment which was delivered by Justice John Inyang Okoro, held that the Resident Electoral Commissioner (REC) who declared Binani winner of the governorship election engaged in act of criminality and irresponsibility.
The court held that Binani engaged in self deceit by hanging to the unlawful and unconstitutional acts of the Resident Electoral Commissioner to hold herself out as winner of the governorship poll.
The court maintained that the Resident Electoral Commissioner REC had no power under any known law to declare election results as he did in the Adamawa governorship election results.
The court clarified that the only person vested with power to make declaration on election is the Returning Officer (RO) appointed by the Independent National Electoral Commission INEC and no other person.
The Supreme Court said that the mere declaration of Binani and APC as winners by the REC was not in anyway helpful to them adding the REC ought to have appeared before the Adamawa State Election Petitions Tribunal to give evidence, defend and justify the declaration he made.
Justice Okoro held that Binani and APC did not in anywhere establish with any oral or documentary exhibits that they won majority of lawful votes cast at the election other than the purported declaration made by the REC.
“From the evidence adduced, the election of March 18 was inconclusive. A supplementary election was ordered and conducted. While the results of the supplementary election was being awaited, the REC did what he did”.
Investigations by Nigerian Concord Newspaper reveal that the Executive Secretary of the Nigerian Shippers Council, Mr. Pius Akutah, has allegedly misappropriated public funds for a lavish lifestyle.
According to our findings, within months of assuming office, Akutah allegedly purchased a bulletproof SUV valued at approximately N850 million. In addition, he is reported to have acquired over twenty exotic SUVs for use as a convoy.
Akutah is also said to have acquired multiple high-value properties, including three in Abuja’s Maitama and Asokoro districts worth over N2 billion, and two in Lagos’ Banana Island valued at N1.8 billion. These acquisitions appear far beyond the scope of his official salary and allowances.
Further investigation suggests that Akutah may be using public funds to support political ambitions, including allegedly grooming militants across 23 local government areas in Benue State for a potential 2027 gubernatorial bid.
Staff of the Shippers Council reportedly claim that Akutah frequently accesses the council’s treasury without proper authorization. Some insiders have indicated that a petition will soon be filed with the EFCC, ICPC, and the Presidency to report his alleged misconduct.
