The Edo State House of Assembly has lodged an appeal against the recent judgment by Justice J. K. Omotosho of the Federal High Court, Abuja, which nullified the impeachment of Philip Shaibu, the state’s former deputy governor.
Following the court’s ruling that cited procedural irregularities in Shaibu’s impeachment process, the Assembly has also filed for a stay of execution on the judgment pending the appeal process.
Justice Omotosho’s decision overturned Shaibu’s impeachment, ordering his immediate reinstatement to office and invalidating the appointment of his successor. The court highlighted that due process was not followed during the impeachment proceedings conducted by the Assembly.
The impeachment saga began when the Edo State House of Assembly, prompted by allegations of misconduct, voted to impeach Shaibu following the findings of a committee led by Justice Daniel Okungbowa. Eighteen members voted in favor of the impeachment, with one abstention.
The appeal filed by the Assembly signifies its intent to contest the court’s decision and uphold its actions against Shaibu, marking a continuation of the legal battle over his removal from office.
