Oil Magnate Akinduro Sues EFCC for Unlawful Declaration

Dr. Henry Bolaji Akinduro, Chairman/CEO of Global Signature Hotel and Total Grace Group Limited, has filed a ₦5 billion lawsuit against the Economic and Financial Crimes Commission (EFCC) for allegedly unlawfully declaring him wanted. The suit was filed at the Federal High Court in Lagos.

In his claim, Akinduro argues that the EFCC declared him wanted without any judicial intervention, violating his constitutional rights. The EFCC announced his status as a wanted individual on October 11, 2024, via its official social media account.

Akinduro is seeking a court order to have his name removed from the wanted list published on the EFCC’s official website and any related platforms. His lawyer, Olalekan Ojo, SAN, emphasized that the EFCC published Akinduro’s name without a court order or formal charges.

Background of the Dispute
The controversy stems from a contractual dispute involving a ₦240 million agreement between Akinduro and a businessman, Mr. Femi Olushakin, who had previously petitioned the EFCC. According to Ojo, Akinduro was invited to the EFCC on June 4, 2024, but could not attend due to medical reasons. He assured the commission of his willingness to cooperate upon his recovery.

The lawyer described the situation as a civil business transaction without any criminal implications. He stated that Olushakin had sold collateral provided by Akinduro, including three Yutong buses and a Toyota 4Runner SUV, which led to the EFCC’s actions.

Despite Akinduro’s medical condition abroad, he has maintained communication with the EFCC, with his legal team regularly updating the commission about his situation. Ojo noted that Akinduro’s legal officer was at the EFCC office on October 11, 2024, to submit correspondence and confirm Akinduro’s intent to cooperate.

The suit highlights ongoing concerns about the proper procedures and rights of individuals involved in investigations by the EFCC.
